Can a Creditor Garnish my Social Security or Pension Benefits?

Social Security and Pension benefits are lawfully protected from garnishment by credit and charge accounts, auto loans and leases, pay day loans, medical bills, utility bills and rental deficiencies.  This protection equally extends to any savings that may have been accumulated from such income sources.

However, alternative types of liabilities may attach either your Social Security or Pension.  Specifically, if you have Court-ordered child or spousal support, a federal income tax deficiency, or a default federally guaranteed student loan, they could potentially garnish those benefits.
