I Have Been Served With a Lawsuit, When I will Have my First Court Date?

A common misunderstanding is that once a lawsuit is filed the Court sets a date for the parties to appear before the Judge.  However, that is not a legal requirement in civil proceedings.  So if the Defendant fails to effectively respond to the Complaint by filing an Answer within twenty-eight (28) days after they have been served with the Summons, the Court could potentially issue a Judgment against them by Default without a formal Hearing having ever been scheduled.
