What is The Difference Between a Municipal and County Court?

Posted by Stefen K. Shamberg | Feb 02, 2023

Creditors have the option of initiating a lawsuit in either a Municipal or County Court depending upon the balance due on account.  The maximum value that a Municipal Court can adjudicate in Ohio is $15,000.00, so a debt in excess of that sum would need to be pursued at the County level.

In comparison, there is neither a minimum or maximum amount that can be demanded in a County Court proceeding.  Therefore, a creditor could initiate a case for a sum that is less than $15,000.00 in that division, or for any other value that may due on the obligation.

So ultimately the choice of where a case will be filed is based on numerous factors, including the balance due, location of the creditor and debtor, where the underlying agreement was secured, as well as a particular Court's procedures in adjudicating civil proceedings.
